1. WHO ARE WE?

DOCAPESCA – Portos e Lotas, SA. (hereinafter, DOCAPESCA for short) is a limited liability company, formed exclusively of public capital, which integrates the state business sector. The statutes of Docapesca are published in the 2nd series of "Diário da República" (journal that publishes all the Laws of State), in the date of 08/27/2015, through the Announcement No. 9698/2015.
DOCAPESCA is in charge of a) the public service for the first sale of fish; b) the administration and operation of fishing ports, auctions and recreational marinas under its jurisdiction, reaching the economic development, exploration and conservation at the multiple aspects of economic, financial, patrimonial, personnel management, administration of the heritage of the state that is attached to it and of port exploration; c) the operation of fishing ports and auctions, under concession or otherwise; d) the development of activities that are complementary, subsidiary or ancillary to the aforementioned activities, ensuring maritime and port security, covering the exercise of the powers and prerogatives of the port authority that are or may be committed to it.
DOCAPESCA is committed to protecting the personal data of Customers/Users of its products and services, as well as the personal data of the respective holders in all situations where personal data is processed by this company or by third parties that proceed the processing of personal data in the name and on behalf of DOCAPESCA, having, in this context, drawn up this Policy, which underpins its commitment to respect the rules for the protection of personal data.

2. WHY THIS PERSONAL DATA PROTECTION POLICY?

This Policy is intended to inform Customers/Users and other Operators of the general rules that that guarantee protection of personal data, which are collected and processed in strict compliance of updated personal data legislation, namely Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter referred to as RGPD for short).
DOCAPESCA respects the best practices in terms of security and protection of personal data, having for this purpose taken the necessary technical and organizational measures in order to ensure with the RGPD, garanteing that the processing of personal data is legal, loyal, transparent and used in limited authorized purposes.
DOCAPESCA is committed to the protection and confidentiality of personal data, having adopted measures to ensure the accuracy, integrity and confidentiality of personal data, as well as all the other rights of the respective holders.
The rules provided for in this Data Protection Policy, complement the dispositions on protection and processing of personal data predicted for all contracts that Customers/Users and other Operators celebrate with DOCAPESCA.

3. WHAT DOES THIS DATA PROTECTION POLICY COVERS?

This Data Protection Policy applies exclusively to the collection and processing of personal data for which DOCAPESCA is responsible for the respective treatment, within the scope of the services and products made available to its Clients/Users and in all situations in which a treatment occurs. of personal data by DOCAPESCA, or by third parties, that process personal data on behalf of and on behalf of DOCAPESCA.

4. WHAT IS PERSONAL DATA?

Personal data is any information, of any nature and regardless of its support, including sound and image, relating to an identified or identifiable natural person.
A natural person is someone who can be identified, directly or indirectly, namely by reference to a name, identification number, location data, electronic identifiers or to one or more specific elements of their physical, physiological, genetic, mental, economic, cultural or social identity.

5. WHAT IS THE PROCESSING OF PERSONAL DATA?

The processing of personal data consists of an operation or set of operations carried out on personal data or sets of personal data, through automated means, or not, particulary the collection, registration, organization, structuring, conservation, adaptation, retrieval, consultation, use, disclosure, dissemination, comparison, interconnection, limitation, deletion or destruction of that data.

The entity responsible for the processing of personal data is DOCAPESCA, which determines the purposes and means of processing them.

7. WHO IS IN CHARGE FOR DATA PROTECTION?

The data protection officer plays an important role in the processing of personal data, ensuring, among other things, the compliance of data processing with updated legislation, ensuring conformity of the process with Data Protection Policy and defining strict rules for this process, guaranteeing that all those who entrust us with the processing of their personal data are aware of how DOCAPESCA treats them and what rights they have in this matter.

8. WHAT ARE THE TYPES OF PERSONAL DATA PROCESSED?

DOCAPESCA, within the scope of EXPO FISH PORTUGAL, processes the personal data useful for the registration of exhibitors and visitors in the activities of that event, such as conferences, virtual exhibition spaces and bilateral meetings, treating data such as the name, the nationality, telephone number and email address.
Without prejudice to compliance with the legal norms relating to the conservation and transmission of data for the purposes of investigation, detection, prosecution of crimes and/or administrative offenses, as well as other treatments to which it is legally obliged, personal data will be processed as necessary to the respective provision of services Personal data are also processed for marketing purposes or the dissemination of DOCAPESCA's offers of goods or services, if the respective holder has authorized it.
Personal data will also be processed, if the respective holder has authorized it, for the purpose of disseminating information services and lists, namely for statistical purposes, including transmission to third parties for the publication of said lists and provision of information services.
If there is prior consent of the data holder, this may be withdrawn at any time, without, however, the lawfulness of the processing carried out based on the consent previously given is compromised.

9. WHEN AND HOW DO WE COLLECT YOUR PERSONAL DATA?

DOCAPESCA collects your personal data, namely by telephone, in writing, through this website and mobile application by filling out registration forms at EXPO FISH PORTUGAL, guaranteeing, whenever necessary, the prior consent of the holder of the personal data.
Some personal data are essential for the execution of the contract or operation of the EXPO FISH PORTUGAL website/mobile application and, in case of lack or insufficiency, DOCAPESCA will not be able to provide the product or service in question, that is, the exhibition and related activities.
The personal data collected can be processed by computer and in an automated or non-automated manner, ensuring in all cases the strict compliance with the personal data protection legislation, being stored in specific databases created for this purpose and, under no circumstances, the collected data will be used for a purpose other than that for which they were collected or given the consent of the data subject.

10. WHO ARE THE RECIPIENTS OF PERSONAL DATA?

Without prejudice to the recipients indicated throughout this Data Protection Policy, DOCAPESCA may communicate the Customer/User's personal data, in order to comply with legal obligations, namely to police, judicial, tax and other public entities in relation to which it is legally obliged to provide information, as well as to third parties that process the personal data of the Customer/User or another Operator, in the name and on behalf of DOCAPESCA.

11. WHAT ARE THE PURPOSES OF PROCESSING PERSONAL DATA AND THEIR LEGAL FOUNDATIONS?

In general, the personal data collected are based on and are intended for the management of the contractual relationship, the provision of contracted services, the adequacy of the services to the needs and interests of the Customer/User, namely for the purpose of accessing specific functionalities of the services, content suggestions, information services, information and marketing actions, satisfaction and opinion surveys, as well as the inclusion of the Client/Users or other Operators in lists, for statistical purposes.
Additionally, personal data may also be processed for the purpose of complying with legal obligations and for purposes of investigation, detection and prosecution of crimes and/or administrative offences.
Without prejudice to the additional information provided when collecting the data, DOCAPESCA may also, upon authorization of the holders or under a legal/contractual obligation, use the personal data provided by the holder for other purposes, such as for the purposes of social intervention actions , sending complaints and suggestions, disseminating information about the company and its operators, and/or making known campaigns, promotions, advertising and news about DOCAPESCA's products and/or services, as well as for carrying out studies of market or valuation surveys.

12. HOW LONG DO WE KEEP YOUR PERSONAL DATA?

The period of time during which personal data are stored and preserved is directly related to the need to complete the EXPO FISH PORTUGAL project, which will be Online on 15 and 16 November, but which will produce results by the end of 2021. So that Docapesca can maintain the contractual relationship with the Clients/Users of the fair, the data will be kept until March 2022.

The holders of personal data are guaranteed, at any time, the right to access, rectify, update, limit and erase their personal data (except for the data that are indispensable for the provision of services by DOCAPESCA, in compliance with legal obligations to which the controller is subject or the processing is necessary for the exercise of public interest functions or the exercise of public authority to which the controller is invested), the right to object to the use of the same for commercial purposes by DOCAPESCA and the withdrawal of consent, without compromising the lawfulness of the processing carried out under this consent, as well as the right to data portability, among other rights provided for in the RGPD.

14. HOW CAN YOU ACCESS, CORRECT, UPDATE, RESTRICT, DELETE, OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA, OR SIMPLY REMOVE THE CONSENT?

Additionally to the dispostions of the General Data Protection Regulation, the holder of the personal data may do so, directly or upon written request, addressed to the respective responsible for processing, through the contacts provided for this purpose in this document, as well as others contacts provided by DOCAPESCA, in the context of EXPO FISH PORTUGAL.

15. HOW CAN YOU RESTRICT CONTACTS FOR MARKETING PURPOSES?

If the holder of personal data has given their consent to DOCAPESCA, the company may promote actions for the release of new products or services with its Clients/Users, namely through telephone, mail, e-mail, SMS, MMS or any other electronic communications service.
If the holder of personal data does not wish to continue receiving these communications, he may, at any time, withdraw his consent to the use of his data for marketing purposes.

17. WHAT MEASURES HAS DOCAPESCA ADOPTED TO ENSURE THE SECURITY OF YOUR PERSONAL DATA?

DOCAPESCA is committed to ensuring the protection of the security of the personal data made available to it, having approved and implemented strict rules in this matter. All people who legally access this data, are required to comply these rules.
Concerning the commitment that DOCAPESCA reveals in the defense of personal data, several security measures, of a technical and organizational nature, were adopted in order to protect the personal data made available, in order to stop its dissemination, loss, misuse, unauthorized alteration, processing or access, as well as against any other form of ilegal processing.
Additionally, comercial partners, that provid services of processing personal data, in the name and on behalf of DOCAPESCA, are obliged to implement appropriate technical and security measures according to updated legislation, ensuring the protection of the holder right's (namely, the protection of privacy and personal data).
In adittion to the security measures adopted by DOCAPESCA, the company alerts all internets users of extra security measures, namely, the use of a PC and a Browser updated in terms of properly configured security patches, with an active firewall, antivirus and anti-spyware that ensure the authenticity of websites. The company also alert users to avoid doubtful websites.

18. WHAT IS THE COMMUNICATION OF DATA TO OTHER ENTITIES (COMMERCIAL PARTNERS AND OTHERS)?

DOCAPESCA, within the scope of its activity, may request to other companies the provision of specifc services. Sometimes, the provision of these services implies access, by those companies to personal data of Customers/Users and other Operators.
When this happens, DOCAPESCA takes the appropriate measures to ensure that the entities that have access to the data are reputable and offer the highest guarantees at this level, which is duly guaranteed by contract between DOCAPESCA and those companies. Thus, any entity subcontracted by DOCAPESCA will process the personal data of Customers/Users or other Operators, in the name and on behalf of DOCAPESCA and adopting necessary technical and organizational measures in order to protect personal data against accidental or unlawful destruction, accidental loss, unauthorized alteration, dissemination or access and against any other form of unlawful processing.
In any case, DOCAPESCA remains responsible for the personal data.

19. UNDER WHAT CIRCUMSTANCES DO WE TRANSFER YOUR PERSONAL DATA?

The provision of certain services by DOCAPESCA may imply the transfer of your data outside Portugal, including outside the European Union or to International Organizations.
In such case, DOCAPESCA will strictly comply legal terms, namely regarding the suitability of the country(ies) of destination, intending the protection of personal data and the legal requirements. This, also, include the signing of appropriate contractual instruments that guarantee the respect of the legal requirements.

20. HOW CAN YOU KNOW ANY CHANGES TO DOCAPESCA'S PERSONAL DATA PROTECTION POLICY?

DOCAPESCA reserves the right at any time to carry out readjustments or changes to this Personal Data Protection Policy, such changes are publicized in the various DOCAPESCA communication channels.
